No contract shall exist between you and Jump 4 Joy Australia Pty Ltd (“Jump4Joy”) until Jump4Joy has sent you an e-mail or telephoned you confirming acceptance of your order.
Sizes and designs of goods being ordered should be checked carefully by the customer to ensure they will meet their requirements before an order is placed as Jump4Joy will not be liable to exchange goods that have been ordered incorrectly. Jump4Joy is entitled to withdraw from any contract in case of errors or inaccuracy regarding the goods or the order appearing on the site. Jump4Joy reserves the right to alter prices, colours, designs and specifications at any time should it be necessary to do so.
Due to the vast range of colours, designs and sizes of goods offered, Jump4Joy cannot guarantee that goods ordered will be held in stock for immediate delivery as goods are usually tailor-made to order. During peak season this may result in delivery being anything upto 14 weeks. When you place an order you will be given a more accurate delivery estimate. Delivery estimates are mere estimates and will be subject to delay if payment is not received for the order or artwork for personalised jumps ordered is not forthcoming.
All prices are quoted ex-works in Australian dollars and are inclusive of GST at the standard Australian rate.

TO CAPITAL CITIES OF MAINLAND AUSTRALIA : Orders under $260.00 incur a delivery charge of $26.00. Orders over $260.00 incur a delivery charge of 10% of the total order value.
ALL OTHER AREAS OF AUSTRALIA : Please contact us for an individual freight quotation
All prices are in Australian dollars and subject to the delivery charges noted above. All goods must be paid for in full before dispatch. Payment may be made by VISA or Mastercard, for card transactions please telephone to arrange direct payment. Cheques will be accepted but goods will not be dispatched until payment has cleared. Goods remain the property of Jump4Joy until paid for in full.
Delivery dates are given as an estimate.
All goods ordered may be collected from Jump4Joy in Bindoon WA, please arrange this when placing an order. Alternatively, a nationwide delivery service is available via a national courier or Jump4Joy’s own vehicle. Please note accurate postal codes are required for courier deliveries.
All deliveries made via courier must be carefully checked and signed for as Jump4Joy cannot be liable for any damages or shortages if goods have been signed for as received in full and in good condition.
You can return any of the goods received to Jump4Joy provided they are unused and in their original condition and packing or packing of similar quality and protection to prevent damage in transit. Any items should be returned within 21 days from the date of dispatch. Jump4Joy does not use a freepost service for returned items. Delivery and insurance for returning items to Jump4Joy will be at the expense of the sender. Jump4Joy will refund or exchange the cost of the goods but is unable to refund the delivery charge for dispatching the goods. Jump4Joy will not be held responsible for items damaged or lost while being returned to the Company. This returns policy does not affect your statutory rights.

8.1 You acknowledge that Jump4Joy own or are licensed to use all copyright, database rights, trade marks and other intellectual property rights in and to all parts of this web site and the business of Jump4Joy (including the structure design and layout of the web site) and assert all such rights worldwide.
8.2 You are entitled to use our web site in accordance with these terms and conditions. You must obtain Jump4Joy prior written consent before you use the web site or any part of it in any other manner.
8.3 All persons, individual and corporate, are prohibited from providing hypertext or other links to the jump4joy.co.uk web site, from their own web site or from a third party's web site, without our prior consent.
9.1 Jump4Joy attempt to ensure that the information available on the web site at any one time is accurate. However we cannot guarantee that it will be fault free.
9.2 Jump4Joy does not accept liability for any errors and admissions and reserves the right to change information, specification and description of listed goods, and products at any time.
9.3 Jump4Joy does not make any warranty that the web site is free from infection by virus or anything else that has contaminating or destructive properties.
9.4 Jump4Joy does not accept liability for any losses or claims arising from any inability to access the web site, or any failure to complete a transaction.
9.5 Jump4Joy does not accept liability for any indirect or consequential loss of any kind in contract, tort or otherwise arising out of use of the web site for any products or services purchased from the web site.
9.6 Jump4Joy will only be liable for direct loss up to a maximum total of the price of the product purchased in respect of any claim.
9.7 Any equine activity by the very nature of the sport entails an element of risk. Jumping has the potential to increase that risk. Jump4Joy, its owners and agents assume no responsibility whatsoever beyond the total cost of the purchased product. The Purchaser of the product and subsequent users of the product assume all responsibility for the use of the product up to and including any injury and/or death associated with the use of such product(s).
9.8 This liability section applies only to the extent permitted by law.
10.1 This Agreement does not confer or purport to confer on any third party any benefits or any right to enforce any term of this Agreement.
10.2 Jump4Joy will not be liable for any delay in or failure to perform obligations if that delay or failure is caused by circumstances beyond their control.
10.3 Time shall not be of the essence in the performance of this Agreement.
10.4 If for any reason any provision of these terms and conditions is unenforceable, the validity of the remaining provisions shall not be affected.
10.5 The terms and conditions and contracts between you and Jump4Joy shall be governed byAustralian law and all disputes shall be submitted to the jurisdiction of the Australian courts.

11. 3 Year Guarantee
11.1 As with any market leading product, it is inevitable that cheap imitations appear on the market. Please don’t be led to believe that because these products look similar that the quality is comparable. We build our products to last and use only the highest quality materials to ensure the lifetime of our products. This is why we are prepared to stand by our product and offer a 3 year limited Guarantee which breaks down as follows:
POLYPROPYLENE MATERIAL (COLOURED PLASTIC)
- - Colour Guarantee - 3 year guarantee against excessive fading due to normal UV conditions.
- - Breakage Guarantee - 3 year warranty against manufacturing defects and breakage under normal use and conditions (which excludes heavy equipment and transportation damage and fair wear and tear in normal equestrian use).
VINYL PRINTS (ON FILLER, PLANKS AND WING DESIGNS):
- - Colour Guarantee - Colours guaranteed for 3 years against fading under normal exposure to UV.
GLASS-FILLED NYLON CUPS AND JUMP BASES:
- - Breakage Guarantee - 3 Year Guarantee against manufacturing defects and breakage under normal use and conditions (which excludes heavy equipment and transportation damage and fair wear and tear in normal equestrian use).
11.2 How the Guarantee Works in Practice.
The 3 year guarantee will be valid on products purchased after 1 February 2010. In all cases evidence and date of purchase will be required. Colour Guarantee – Where an item is covered by the Colour Guarantee, Jump 4 Joy will replace the item (or the affected part of it, whichever it deems more appropriate) free of charge. The customer will be required to provide visual evidence of the fading and return the item itself to Jump 4 Joy for further analysis of the problem. Breakage Guarantee – Where an item is covered by the Breakage Guarantee, Jump 4 Joy will replace the broken parts or make repairs, whichever it deems more appropriate. Where an item breaks due to a manufacturing defect Jump 4 Joy will replace the item or repair it (whichever it deems more appropriate) free of charge. Where an item is covered by the Breakage Guarantee for breakage other than a manufacturing defect, Jump 4 Joy will pro-rate the cost of replacement over the 3 year term at 33% per year. The customer is responsible for returning the damaged item(s) and paying freight charges to replace them or have them repaired. The bottom line is that we will do what we can for you to get the most life out of your Jump 4 Joy products as possible.
